The Supreme Court has issued a unanimous ruling in a case involving a Lutheran school and an employee who was fired from the school.
The worker – a woman who worked as a religious teacher – says she was not allowed back at the school after taking a leave of absence for a sleep disorder. The woman claims the schools violated the Americans with Disabilities Act.
The High Court ruled last week that religious employees of a church can not sue for employment discrimination – acknowledging a so-called “ministerial exception” to anti-discrimination laws.
To talk more about this, I’m joined on the phone by Mark Rienzi is a professor of constitutional law at the Catholic University of America. Mr. Rienzi is also an attorney with the non-profit Becket Fund for Religious Liberty, which represented the church in court.
